Embattled Mufti Mubajje fined Shs20m for attempting to steal school land

COURT. The embattled Mufti of Uganda Sheikh Shaban Mubajje is back in the news ,this time implicated in scheming to steal a piece of land belonging to a private school in Wakiso District .
In a judgment dated September 26,2025, acting Wakiso High Court judge Grace Flavia Lamuno fined Mubajje Shs20m in general ,special and exemplary damages over trespassing on a piece of land belonging to Alliance High School in Nansana Municipality.


The school sued Mubajje and Aisha Kayongo ,seeking ,among other things , a declaration that the school is the rightful owner of the land and that Mubajje is a trespasser .
In the judgment , justice Lamuno ruled: “ A permanent injunction is issued restraining the first defendant (Mubajje) ,his agents ,servants ,employees and workmen from trespassing ,alienating ,entering , harassing ,intimidating or in any other way interfering wit5h the plaintiff’s (Alliance High School) use and quiet enjoyment of the suit land”


The judge ordered Mubajje to pay ShsShs572,000 to Alliance High School in special damages , Shs10m in general damages and another Shs10m in exemplary damages at5 an interest rate of 10 percent per annum until fully paid .


Pronouncing Mubajje a trespasser on the suit land , Justice Lamuno noted that while Mubajje claimed that he had owned the land since 2013, it is inconceivable that the dispute between the parties arose in 2021. Alliance High School stated that i5t purchased the land in question from Muhammad Katongole in 2018.


In a courter-claim that was dismissed by the court, Mubajje said he bought the same piece of land from Ahmed Ssenyonga on March 23,2013.H5e thus insisted that his entry onto the land was lawful .
In a police a statement ,Ssenyonga,said he approached Mubajje and borrowed Shs85million from him to save his land , which he had pledged as security with MARE Enterprises .


He, however , noted that Mubajje made him sign an agreement showing that he had sold the land to him ,although it was a loan5 transaction.
Ssenyonga said that he paid the money back to Mubajje in instalments .Thus ,in 2017 ,he sold the land to Katongole .


However , Mubajje and Kayongo contended that the transaction between Ssenyonga and Katongole was fraudulent .Mubajje ,who assumed office of Mufti in December 2000 has in the past two decades been embroiled by various fraudulent land- related transactions with a section of Muslims accusing him of selling community prime proprieties across the country .

Although ,in some of the cases Mubajje was exonerated by court , Muslim scholars insisted that his image had been tainted and was no longer fit to continue leading the Islamic faith in Uganda ,but he stayed put and remained in office . More controversy emerged two years ago when he clandestinely amended the Uganda Muslim Supreme Council constitution to grant himself a five-year extension under the guise of “preparing a smooth transition. His legal tenure of office expired on March 12,2025 after clocking 70 years .
