The Office of the Director of Public Prosecutions (DPP) has strongly opposed former Kampala Lord Mayor Erias Lukwago’s application for bail, urging the High Court to dismiss it.In submissions presented by Chief State Attorney Joseph Kyomuhendo, the prosecution argued that Lukwago has not provided sufficient grounds for release pending trial.
The State rejected claims that Lukwago was beaten in detention or subjected to forced physical drills and push-ups. It also disputed assertions that Murchison Bay Prison cannot adequately address his medical needs, insisting that the Uganda Prisons Service medical team can effectively manage any health conditions
.The DPP highlighted Lukwago’s significant flight risk, noting that he faces charges of misprision of treason, which carry a maximum penalty of life imprisonment.
Prosecutors warned that granting bail could encourage him to abscond and undermine the ongoing case. They further argued that the proposed sureties are not substantial enough to guarantee his appearance in court.
Additionally, the State expressed concern over potential witness interference. It described Lukwago as a senior lawyer, prominent politician, former Lord Mayor, and leading figure in the People’s Front for Freedom, saying his influence could be used to compromise witnesses who are known to him.
The prosecution maintained that the charges — stemming from allegations that Lukwago failed to inform authorities about an alleged plot by Dr. Kizza Besigye and Hajji Lutale to overthrow the government using firearms — involve serious offences that threaten national security. Releasing him, they said, would not be in the interests of justice.Lukwago was arrested and remanded last month.
He is seeking bail primarily on medical grounds, requesting permission to travel to India for surgery. During today’s court appearance before Justice David Matovu, he asked to be returned to Mulago Hospital for treatment while awaiting the bail ruling.
The prison officer escorting him informed the court that consultation would be required on the hospital request.Justice Matovu has directed parties to file written submissions and indicated he will deliver his ruling on the bail application this Thursday via the Court’s Electronic Case Management System.
