
Kampala High Court has scheduled April 11th to rule on the bail applications of opposition politician Dr. Kizza Besigye and his co-accused, Hajji Obeid Lutaale Kamulegeya.
Besigye and Lutaale, detained at Luzira prison for over three months, appeared before Lady Justice Rosette Kania Comfort of the Criminal Division.
The judge instructed both the defense and prosecution to submit written arguments by March 31st. Originally set for a hearing today, the prosecution requested more time to respond to “serious matters” raised in the defense’s affidavits and to verify the sureties.
Chief State Attorneys Richard Birivumbuka and Joseph Kyomuhendo cited their heavy caseload in the International Crimes Division and initially sought two weeks, but Justice Kania granted them until Wednesday to file their responses.
Despite the prosecution’s delay, the defense, led by Ernest Kalibala and Erias Lukwago, presented the sureties. Besigye’s sureties include Members of Parliament Ibrahim Ssemujju Nganda, Muhindo Tonny, Francis Mwijukye, and Nicholas Kamara. Lutaale’s sureties are his wife Halima Nagitta, brother Ssewankabo Hamza, and daughter Nanfuka Zura. The court explained the sureties’ responsibilities, including ensuring the accused’s court appearances and the potential forfeiture of bail bonds.
Besigye and Lutaale, charged with treason since November 16, 2023, are accused of conspiring with UPDF Captain Dennis Oola to overthrow the Ugandan government. They were returned to custody pending the bail ruling. Their lawyers will also attend a Nakawa Chief Magistrates Court hearing regarding the state’s request for access to their mobile phones.
In their bail application, Besigye and Lutaale argued they have been detained for over 100 days without a clear timeline for investigations or trial. Besigye asserted his commitment to abiding by the law, citing his consistent court appearances after previous bail grants. He emphasized his unblemished record, stating he has never been convicted despite facing numerous charges, including serious allegations like rape, treason, and terrorism.
